Rental Terms & Conditions

Rental Term and charges - This agreement shall commence from the time specified as delivery or customer pick-up time and will remain in full force and effect until the time item(s) is/are returned by the customer or picked up by the Company or until terminated by either party in accordance with this Agreement. Rental charges will apply from the time rentals leave until the items are returned to the Company premises.

Payment. The customer shall pay 50% of the total invoice amount as a non-refundable deposit to reserve the item/(s) for the requested period. Remaining 50% shall be paid at scheduled customer pickup or one week prior to the delivery of items to the customer.

Security Deposit.  The customer shall provide a valid credit card details to keep on file and authorization for an amount of $200.00. Credit Card details are held until all the rental items have been returned in its original condition to the Company.

Late Payment. The customer agrees to pay a late fee of 50% of the rental amount of each item each day after the agreed return date.

Damage Waiver. The customer shall be charged automatically an 8% of rental amount as damage protection charge unless declined. This damage protection will protect customer from paying in full for any potential damages to the rented items. The customer shall not be charged for first $100.00 of damages and 50% of any additional damages from any causes excluding listed below;

  1. Loss or damage due to theft, disappearance;
  2. Loss or damage due to not following the rated capacity of equipment;
  3. Loss or damage due to improper handling and transporting;
  4. Intentional Loss or damages
  5. Loss or damage to the linens due to wax, burns, cuts;

 Care of Rented Items. All the rented items shall remain the responsibility of the customer from the time of delivery/customer pick-up to the time of its return.  Items are to be used for their intended purposes with normal wear and protected from damage due to neglect, abuse or misuse.

Repair and Alterations. Item(s) shall not be serviced or repaired, and parts and accessories shall not be replaced without the Company’s prior consent. 

Loss or Damage. The customer shall alert the Company to any damage to the item(s) after the intended rental use.  The customer shall be responsible for any loss or damage to item(s) and loss of use, diminution of the item’s value caused by damage to it or repairs to it and missing item(s). The Customer will be charged for the full replacement or repair cost of any damaged/lost item(s). 

Condition of Item(s). The customer accepts and hire the items on an “as is” basis.  The Customer shall ensure at the time of customer pick up or delivery, that items(s) received is/are in good working condition and declares that the customer fully understands its proper operation and use. Once the item(s) are picked up by the Customer or accepted on delivery, items are deemed to be in good condition unless noted on the rental contract otherwise.

 Return of Rented Items. The customer shall return all item(s) on a specified date in the same condition as the Customer received it, except for normal wear and tear. The customer shall return the item(s) to the agreed return location. If item(s) is/are not returned on the specified date & time, the Company reserves the right to charge a 50% late fee as noted in the payment terms or the consider the item lost and the Customer will be charged for the full replacement of any lost rental item(s). 

 Linen shall be returned free from any debris, food or confetti, and chair wrap shall be returned with untied knot. Additional charges may apply in the event of chair ties and wraps returned with tied knots.

 Termination or Cancellation. The customer may cancel this Agreement by giving at least 4 weeks’ notice to the Company. In the event a cancellation is requested by the Customer within two weeks prior to the event date, the Company reserves the right to charge the customer 50% of the total rental amount stipulated in this Agreement for restocking and administrative purposes.

 Indemnification and Liability.  The customer shall accept all responsibility and liability (including attorney’s fees and expenses of litigation) for any property damage or personal injury arising from Customer’s use of item(s) by any cause, except to the extent caused by Company’s gross negligence or willful misconduct.  The provisions of this Article shall survive the termination of this Agreement with respect to any claims or liability accruing before such termination.  IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGES ARISING FROM THE CUSTOMER’S USE OF ITEM(S), INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS AND LOSS OF REVENUE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. 

Ownership. All the item(s) rented by the Customer under this agreement remain the property of the Company.

 Entire Agreement.  This agreement represents the entire understanding relating to the subject matter hereof and prevails over any prior or contemporaneous, conflicting or additional communications.  This Agreement can only be modified by a written amendment signed by the party against whom enforcement of such modification is sought.

 Assignment.  The customer may not, without the prior written consent of Company, transfer or assign this Agreement or any part thereof.  Any attempt to do so shall be a material default of this Agreement and shall be void.

 The customer acknowledges receipt of a copy of this agreement and acknowledges having read and understood the foregoing. Both parties agree that documents and typed signatures, exchanged by fax or e mail, are accepted as original documents and original signatures
